XDK Competition Terms and Conditions
Bosch Connected Devices and Solutions GmbH, Ludwig-Erhard-Straße 2, 72760 Reutlingen, GERMANY (“Bosch”) is planning to conduct a customer survey (“XDK Survey”) amongst the members of its XDK community (“XDK Community”). Amongs the participants in the XDK Survey Bosch will award a prize which will be drawn by lucky draw (“XDK Competition”).
In the following you will find the terms and conditions for participation in the XDK Competition (“Terms and Conditions”).

Participants must complete the following steps and take note of the following details:
To participate in the XDK Competition you must be a member of the XDK Community and have submitted the XDK Survey.
To participate in the XDK Survey please go to the XDK Community web page at http://xdk.io/community and log in. There you will find a link which directs you to the XDK Survey at SurveyMonkey.
Multiple submissions of XDK Surveys by one Participant will be counted as a single submission.
2. Data Privacy
If you are the winner, by agreeing to these Terms and Conditions, you allow us to publish your name on the XDK Community web page as well as on Bosch social media channels.
3. XDK Competition Period
In order to participate in the XDK Competition the XDK Survey must be submitted within the period of [06.02.2019 [00:00] CET and [15.03.2019], [00:00] CET (“Competition Period”). Only XDK Surveys submitted within the Survey Period will be taken into consideration for the XDK Competition .
4. Conditions of Participation
Participants must be natural persons of full age (adult) and full legal capacity, with permanent residence in Germany, Austria or Switzerland.
Employees of Bosch Connected Devices and Solutions GmbH and other companies involved in the running this XDK Competition are excluded from participating. This also applies to spouses, registered partners and first and second degree relatives of such employees.
Bosch reserves the right to exclude participants from the XDK Competition for justified reasons. These may include, for example, a serious violation of these Terms and Conditions and/or the manipulation or influencing of this XDK Competition in any way.
The participation in this XDK Competition is free of charge and not subject to the purchase of products or services. The participant shall bear the costs for the online connection in connection with the participation in this XDK Survey and XDK Competition.
5. Prize, Winner and Notification of Winner
Prize: One (1) Apple I-Pad Generation 6.
After expiry of the Competition Period we will select the winner among the participants in the XDK Survey in the form of a lucky draw.
Bosch will inform the winner within 14 days after the expiry of the Competition Period via e-mail. The winner is given a 14 days period as from the shipping date of the e-mail to accept the prize by sending a reply e-mail to Bosch providing their full name, date of birth and postal address. In case the winner fails to accept the prize within the aforementioned period or fails to provide his/her personal data as stipulated above, his/her entitlement to the prize shall be forfeited and the prize will not be drawn anew.
Bosch will bear the cost of shipping the prize. Delivery times may vary from country to country.
The prize cannot be exchanged for a cash payment. The prize is not transferable. The winner shall bear any taxes due on the acceptance of the prize.
Bosch shall only be liable for damage resulting from breach of contractual or non-contractual obligations in the following cases:
- damage caused intentionally or through gross negligence
- bodily injury or death caused intentionally or through negligence
- Bosch has provided a durability or quality guarantee
- mandatory liability under the German Product Liability Act (in German: Produkthaftungsgesetz).intentional or negligent breach of material contractual obligations. If, however, material contractual obligations are breached due to minor negligence and such a breach does not lead to bodily injury or death, Bosch is only liable for typical, foreseeable damage. A material contractual obligation in this context is one which the participant expected and had the right to expect would be fulfilled and which is characteristic of the contractual relationship between Bosch and the participant.
Regardless of the legal nature of the claim brought forth, Bosch shall not be liable for any other damage. Bosch shall especially not be liable for technical disruptions such as internet connection outages.
As a participant, you alone are responsible for any information or content that you submit to Bosch via the XDK Survey website.
7. Early termination
Bosch reserves the right to amend these Terms and Conditions or terminate or temporarily suspend the XDK Competition for good reason without giving prior notice. That is in particular the case if the administration, security, fairness integrity or proper conduct of the XDK Competition can no longer be guaranteed due to malfunctions, disturbances, viruses or similar damage.
In case a participant breaches these Terms and Conditions, Bosch reserves the right to exclude such participants from the XDK Competition.
These terms and conditions are subject to the laws of the Federal Republic of Germany, unless you are a consumer and can call upon the mandatory consumer-protection regulations of your country of residence.
Sole jurisdiction for resolving any legal disputes resulting in connection with these Terms and Conditions shall be the German courts. Bosch may also seek injunctive relief or other similar types of emergency legal recourse in any jurisdiction.If one of the terms of these conditions of participation is or becomes invalid, the validity of the remaining terms will not be affected as a result.
The result of the prize draw is final, legal recourse to the courts is excluded.
